Privacy Policy

This privacy notice explains how Ava Payments collects, uses and protects your personal information when you request a quote, use our free Fee Saver tool, or otherwise interact with this website. It is written to meet our obligations under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Please read it alongside our Terms of Use and Legal information pages.

Who we are and how to contact us

Ava Payments is an independent introducer of card payment services. For anything relating to this notice or your personal information, we are the data controller, which means we decide how and why your data is used.

If you have a question about your data, or you want to exercise any of the rights described below, you can email us at privacy@avapayments.co.uk. For general enquiries you can also use the request a quote page on this website.

What information we collect

When you request a quote, we collect the details you give us so that we can prepare a like-for-like comparison. This normally includes:

  • your name and business name;
  • your email address and phone number;
  • your business sector or type of business;
  • your approximate monthly card takings; and
  • anything else you choose to tell us in your message.

When you use our free Fee Saver tool, you upload a recent card-processing or merchant statement so that an automated system can estimate your true effective rate and break down your fees. As explained in the section on statement uploads below, personal and identifying details in that document are automatically detected and removed, the raw file is processed transiently and is not stored, and we keep only the anonymised figures together with any contact details you choose to submit.

We also collect limited technical information needed to keep the website working and secure, such as information stored by essential cookies. We do not use advertising trackers.

How we use your information and our lawful bases

We only use your personal information where the law allows us to. The lawful bases we rely on are:

  • Consent, where you have chosen to send us an enquiry or upload a statement so that we can prepare and send you a quote or estimate. You can withdraw your consent at any time.
  • Legitimate interests, where we use your details to respond to you, to run and improve our service, and to keep our website secure, in a way you would reasonably expect and that does not override your rights.
  • Contract, where we need to use your information to take steps at your request before entering into an arrangement, or to help set up a product you decide to go ahead with.
  • Legal obligation, where we need to keep certain records to comply with the law.

Who we share it with

We do not sell your personal information to anyone. We share it only where it is necessary, and only with:

  • Regulated partner providers, where you decide to go ahead with a product such as card acquiring, a terminal, a business account or funding. In that case we pass on only the details needed for the provider to set up the product and carry out their own eligibility checks. The provider then handles your information under their own privacy policy.
  • Service providers who help us run our business, such as our email, hosting and IT suppliers, who may only process your information on our instructions.

We may also disclose information where we are required to do so by law, or to protect our rights, property or safety.

Statement uploads and anonymisation

The Fee Saver tool is designed to protect your privacy by default. When you upload a statement, an automated system detects personal and identifying details, such as names, addresses, account numbers and similar information, and removes them before your figures are stored. The uploaded file itself is processed transiently in order to read the figures and is not retained afterwards. What we keep is the anonymised fee information the tool produces, plus any contact details you submit so that we can prepare a like-for-like quote and get back to you.

International transfers

We aim to keep your personal information within the United Kingdom or the European Economic Area. Where any of our service providers process information outside these areas, we take steps to make sure it is protected by appropriate safeguards, such as approved contractual protections, in line with data protection law.

How long we keep your information

We keep enquiry details for up to 12 months from your last contact with us, unless you become a customer. Where you go ahead with a product, we keep the records we need for as long as necessary to provide the service and to meet our legal obligations. Uploaded statements are not retained, as explained above. When we no longer need your information, we delete it or make it anonymous.

Cookies

We use only essential and functional cookies that are needed to make the website work and keep it secure. We do not use advertising or cross-site tracking cookies, and we do not build advertising profiles about you. You can control or delete cookies through your browser settings, although some parts of the site may not work properly if you do.

Your rights

Under data protection law you have a number of rights over your personal information. You can:

  • ask for a copy of the information we hold about you (access);
  • ask us to correct information that is wrong or incomplete (rectification);
  • ask us to delete your information (erasure);
  • ask us to restrict how we use it (restriction);
  • object to us using it in certain ways (objection);
  • ask us to transfer it to another provider where this applies (portability); and
  • withdraw your consent at any time where we rely on consent.

To exercise any of these rights, email us at privacy@avapayments.co.uk. We will not charge you in most cases, and we will respond within the time limits set by law.

How to complain

If you are unhappy with how we have handled your personal information, please contact us first at privacy@avapayments.co.uk so that we have the chance to put things right. You also have the right to complain to the Information Commissioner's Office (ICO), the UK regulator for data protection, at ico.org.uk.

Changes to this notice

We may update this notice from time to time to reflect changes in our services or the law. When we do, we will update the date below and, where appropriate, let you know.
